Terms and Conditions

These terms govern the use of Fyko Menu by restaurant operators, branch users, and public users interacting with Fyko Menu-powered ordering pages, table QR flows and related digital services.

These pages are written for Fyko Menu's current UAE-facing business model, including restaurant SaaS subscriptions, branch operations, customer ordering, WhatsApp alerts, add-on services, and digital display modules. Where UAE law requires mandatory consumer rights, privacy rights, or Arabic disclosures, those requirements continue to apply in addition to these pages.

Consumer rights, privacy rights, and mandatory UAE rules continue to apply even where these terms are silent.
Section 1

Scope and acceptance

These Terms and Conditions govern access to and use of Fyko Menu, including its websites, restaurant onboarding flows, branch portals, QR menu pages, table-order flows, WhatsApp-connected workflows, public showcase pages, TV modules, and related software, content, support and add-on services.

By registering, logging in, creating an account, approving a request, activating a feature, placing an order through a Fyko Menu-powered page, scanning a table QR, or otherwise using Fyko Menu, you agree to be bound by these terms to the extent applicable to your role.

If you are using Fyko Menu on behalf of a restaurant, branch, company, or other legal person, you confirm that you have authority to bind that entity.

Electronic acceptance, digital records, and online workflows may be relied on as evidence of agreement and operational instructions, subject to applicable UAE law on electronic transactions and trust services.

Section 2

Service model and role allocation

Fyko Menu is a software and digital operations platform for restaurants. Depending on the active plan and add-ons, it may provide menu publishing, online ordering, table QR, branch operations, customer-facing showcase pages, billing tools, WhatsApp order alerts, KOD screens, TV screens, and related support functions.

Unless expressly agreed otherwise in writing, Fyko Menu is not the merchant of record for food and beverage transactions shown on restaurant or branch ordering pages. The relevant restaurant or branch remains responsible for:

  • food and beverage preparation, quality, safety and legality
  • menu accuracy, allergen information and lawful product descriptions
  • displayed prices, taxes, charges and discounts
  • accepting, rejecting, preparing or completing orders
  • delivery, collection or dine-in fulfilment
  • refunds, cancellations, complaints and statutory consumer remedies
  • holding and maintaining all licences, permits and approvals needed for its operations

Restaurants using Fyko Menu for e-commerce or consumer-facing sales must ensure that mandatory product, service, contract, pricing, payment, warranty and complaint information is provided in compliance with UAE law, including Arabic disclosure requirements where applicable.

Section 3

Accounts, credentials and operational security

Fyko Menu may provide super admin, restaurant admin and branch admin access. Users must keep credentials confidential and must not share access in a way that undermines traceability or security.

Fyko Menu may also issue time-limited or one-time access methods, including branch magic login links and operational pairing PINs. Those tools are security features and must not be sold, copied, automated, brute-forced or used outside their intended purpose.

You must notify Fyko Menu promptly if you believe any account, device, branch login link, TV pairing route, or WhatsApp flow has been compromised.

Fyko Menu may log authentication events, request IDs, device pairing records, and operational actions for security, billing, and audit purposes.

Section 4

Orders, public pages and restaurant obligations

Fyko Menu-powered menus and ordering pages are digital routing tools. Orders placed through those pages may be transmitted to the relevant restaurant or branch through the Fyko Menu interface, WhatsApp alerts, branch portals, KOD screens, or related operational channels.

The restaurant is responsible for reviewing, accepting, rejecting, updating and fulfilling the order. Customers should understand that order acceptance is subject to branch availability, timing, stock, pricing accuracy, and restaurant confirmation.

Where the current Fyko Menu build asks a customer to select a payment method, that does not mean Fyko Menu has independently processed or stored card details. In the current build, Fyko Menu may record the selected payment method and order details, but restaurants remain responsible for the actual sale, invoice and any payment collection process unless another written arrangement applies.

Restaurants are responsible for ensuring that consumer-facing prices and tax disclosures comply with UAE law, including any VAT treatment or invoice requirements that apply to their goods or services.

For table QR deployments, the restaurant is responsible for placing and managing QR codes in a way that does not mislead customers and for removing or replacing any printed codes that are no longer valid.

Section 5

Fees, subscriptions, recurring billing and add-ons

Fyko Menu may charge recurring or one-time fees for plans, branch capacity, screen capacity, premium modules, and fulfilment services. Unless otherwise stated in a signed proposal or invoice, prices are in AED.

Monthly and yearly plans may be billed in advance. Add-ons may be billed monthly, yearly, per unit, or one-time, depending on the active catalog and approved order.

Unless Fyko Menu expressly states that a quoted amount is VAT-inclusive, applicable UAE VAT or similar indirect tax may be added where required by law. Restaurants are separately responsible for taxes arising from their own sales to customers.

One-time or manually fulfilled add-ons, such as flipbook setup, website delivery, onboarding work, data-entry work, media preparation or similar service outputs, may begin after approval and may become non-refundable once work has started, resources have been allocated, or a deliverable has been issued, except to the extent mandatory law requires otherwise.

If an account is overdue, Fyko Menu may restrict, pause, downgrade or suspend access, including add-on features or operational screens, after reasonable internal processing or notice consistent with the platform workflow or applicable agreement.

Section 6

Acceptable use, content restrictions and intellectual property

You must not use Fyko Menu to publish unlawful content, impersonate others, interfere with platform security, misroute orders, scrape or reverse-engineer the service, overload the infrastructure, abuse WhatsApp messaging flows, or bypass licensing, pairing, or access controls.

Fyko Menu and its underlying software, layout, workflows, service marks, documentation and platform logic remain the property of their respective owner/licensor. Restaurants retain rights in their own menus, logos, media and business data, subject to the licence required for Fyko Menu to host, display, route and operate that content.

Section 7

Privacy, data handling and third-party services

Fyko Menu processes business and operational data to provide the service. That may include restaurant data, branch data, user credentials, customer order data, table data, uploaded PDFs, images, videos, WhatsApp logs, usage records, request records, and billing records.

Where a restaurant uses Fyko Menu to take or route customer orders, the restaurant remains responsible for the lawful basis of its customer relationship and the accuracy of the instructions it gives through the platform. Fyko Menu may act as a platform operator or service provider for those workflows and may use service providers and messaging vendors, including Meta/WhatsApp-connected infrastructure, to deliver the functionality.

Your use of Fyko Menu is also subject to the Privacy Policy.

Section 8

Availability, disclaimers, suspension and liability limits

Fyko Menu aims to keep the platform available, but availability may be affected by maintenance, hosting, internet conditions, third-party providers, Meta/WhatsApp service changes, or circumstances outside reasonable control.

Except where mandatory law provides otherwise, Fyko Menu provides the platform on an "as available" basis and does not guarantee uninterrupted availability, acceptance of every order, or compatibility with every external device, browser, channel or third-party provider.

To the maximum extent permitted by applicable law, Fyko Menu is not liable for indirect, incidental, consequential, punitive or special loss, including loss of profit, loss of business, loss of expected sales, business interruption, data corruption, reputational loss, or restaurant-level service failures caused by incorrect menu data, branch non-response, staff misuse, customer misuse, internet failure, or third-party outages.

Fyko Menu may suspend, restrict or terminate access where reasonably necessary for security, non-payment, misuse, fraud risk, legal compliance, infrastructure protection, or breach of these terms.

Section 9

UAE law, consumer rights and disputes

These terms are intended to operate consistently with applicable law in the United Arab Emirates, including the legal framework for consumer protection, personal data protection, modern technology-based trade, electronic transactions and trust services, and applicable tax rules.

Nothing in these terms is intended to exclude mandatory consumer rights, data subject rights, statutory complaint rights, or compulsory legal obligations that cannot lawfully be waived under UAE law.

These terms are governed by the laws of the United Arab Emirates. The competent courts of the UAE shall have jurisdiction, unless mandatory law requires another forum or another contractual document signed by the relevant parties specifies a valid forum.

Fyko Menu may update these terms from time to time. Material updates may be published on the website or made available through the platform.
